There has already been much written about the fishing rights application process of 2013 (FRAP 2013) and we anticipate much more will be written regarding this process over the next year (including the content of High Court affidavits).

As most in the fishing industry will be aware, long term fishing rights were recently allocated in 8 different sectors under the FRAP 2013 process.

We have recently been involved in a number of matters involving fishing industry players and the South African Revenue Service (SARS). In some of these instances we have found ourselves asking the question: Does SARS have the jurisdiction and/or the power to act in the manner in which it is acting?

The Department is under extreme time constraints to bring about proposed amendments to the MLRA as well as completing future rights allocation processes.
